Equal Opportunity in Land Sales – Local Government

Recently the Supreme Court made an important ruling on the question of whether the government may sell one plot of land for one. It follows from the ruling that the governmental body must provide (potential) space for candidates to compete in the sale of immovable property. The public body must be transparent about the availability of immovable property, the selection procedure, the schedule and the selection criteria to be applied. If there is only one serious candidate, the intent to sell should be announced to everyone at the appropriate time.

The ruling raises many questions. What do you do, for example, in the case of ongoing negotiations and/or sales agreements that have been concluded but not yet implemented? Are these agreements null and void? And when is there only one serious candidate? And does case law also apply to other agreements relating to immovable property, such as land lease or lease?

These questions will be discussed during our webinar on Wednesday 22nd December from 13.00 to 15.00 at the latest.
